Definitions

For the purposes of this Privacy Policy:
 
  • Application refers to the IPitomy Cloud application for iOS, the IPitomy Cloud application for Android, and the IPitomy Cloud application for desktop platforms; published by IPitomy Communications, LLC;
  • Company (referred to as either "the Company", “Our”, “Us” or "We" in this privacy policy) refers to IPitomy Communications, LLC, whose head office is at 2837 Cattlemen Rd, Sarasota FL, 34232
  • Service means - VoIP service for calls, instant messaging, and collaboration provided via the Application
  • Personal Data is any information that specifically identifies an individual (such as your name, user name, address or e-mail address), processed by the Company for the purposes set forth in this privacy policy. Personal Data also includes any information about an individual that is directly linked to personally identifiable information and is processed by the Company for the purposes set forth in this privacy policy. Personal information does not include “aggregate” information, which is data the Company collects about the use of the Service (such as automated crash reports) or about a group or category of users, from which individual identities or other personal information has been removed. This privacy policy in no way restricts or limits our collection and use of aggregate information.
  • Company (referred to as either "the Company", “Our”, “Us” or "We" in this privacy policy) refers to IPitomy Communications, LLC, whose head office is at 2837 Cattlemen Rd, Sarasota FL, 34232
  • Device means any device that can access the Service such as a cell phone, tablet or a computer,that allows the Application to be downloaded and the Service to be used
  • User means a natural person using the Application for personal or professional purposes.
 

Privacy information access preface

Company is very concerned for the privacy of the users of our products. To this extent, no user information is collected except when necessary for using a specific feature of our products (Apple Push Notification Service, Firebase Cloud Messaging) and is never shared with any third parties. The only time information is requested other than listed here is for use in troubleshooting technical issues and of course, the user has the option to refuse in that case (though that may negatively affect our ability to resolve any issues).
 
This privacy policy contains the full list of features built into the Application that in any way process users’ private information. Whether a feature is enabled or not, and thus whether the private information required for the feature to work is accessed, depends solely on the SIP account configuration in the Application.
 

Push Notifications

In order for Push Notifications to work, we must register your account remotely when the Application is in the background or closed on your iOS or Android device. To accomplish this, we transmit your SIP account details to SIPIS (our server that handles push notifications) over a HTTPS – secure connection. This information is shared with no one and is erased immediately when the push instance expires (usually within 3-6 days, depending on SIP account configuration) or the user disables Push Notifications in the Application. If the SIP account is configured to use one of our methods for multitasking instead of Push Notifications, this information is not sent to SIPIS. 
 

Mobile App Contacts Usage

This part of the privacy statement describes how the Company collects and uses the contact information you provide by granting the contacts access permission
in the Application. It also describes the choices available to you regarding our use of your information and how you can access and update this information.
 
We access the following personal information from your address book:
  • Contacts’ names
  • Contacts’ email
  • Contacts’ telephones
  • Contacts’ organization
  • Contacts’ postal address
  • Contacts’ birthday
  • Contacts’ gender
 
We use this information to
  • Populate your Contacts data in the app.
  • To import your favorite contacts into the QuickDial list, if you also enable the “Busy Lamp Field” feature on a contact, the favorite contact’s number (URI) will be included in your SIP traffic, but will not be stored anywhere.
  • Enable the Smart Contacts feature, which helps you to make free calls and enjoy seamless communication with other users with SIP accounts on the same provider.
  • If your SIP account is configured to use the Smart Contacts feature, we securely upload your contacts to the server in order to recognize Application users among your contacts. 
 
We will only use your Contacts information for the specific reason for which it was provided to us.
 

Mobile App Location Information Usage

This part of the privacy statement describes how the Company uses the location information you provide by granting the Location access permission in the Application.
 
We ask the location access permission only if the SIP account is configured to do so, and only in the following use cases:
  • When the SIP account is used in a country with Dispatchable Location for emergency calls legal requirement. 
  • In this situation, the app attempts to acquire your location information in case a call to an emergency number is placed. Please note that emergency calls are usually routed to your phone's native dialer instead of requesting location access. Please consult with support to learn how emergency calls are handled for your account.
  • when the SIP account is configured to send location data during SIP registration 
 
We will only use your Location information for the specific reason for which it was provided to us.
 

Mobile App Media Files and Documents usage

This part of the privacy statement describes how the Company uses media files and documents shared with the Application. Depending on the operating system, you may need to grant additional file access-related permissions to the Application in order for the Application to access files.
 
We process your files such as photos, videos, and documents; only if the SIP account is configured to do so, and only in the following use cases:
  • When you select the option to share a media or file attachment via a multimedia message.
    We always access only the files that have been explicitly shared with the Application.
    The attached files are always encrypted and securely uploaded to a server in order for the message recipient to download them later.
  • Other use cases in which the files never leave your device. An example of such a use case is adding a photo avatar to a favorite contact (also referred to as “QuickDial”).
 
 
We will only use your files for the specific reason for which they were provided to us.
 

Google Calendar usage

This privacy statement describes how the Company collects and uses the information you provide in your Google Calendar account via the Application for our UCaaS products. It also describes the choices available to you regarding our use of your information and how you can access and update this information.
 
We collect the following personal information from your Google Calendar and Google Contacts account:
  • Event name
  • Event date
  • Event time
  • Event description (will be inserted as a note)
  • Event location (will be inserted as a note)
  • Contacts’ names
  • Contacts’ email
  • Contacts’ telephones
  • Contacts’ organization
  • Contacts’ postal address
  • Contacts’ birthday
  • Contacts’ gender
 
We add/import the following personal information from your “Cloud Softphone” account to your Google Calendar & Google Contacts account:
  • Event name
  • Event date
  • Event time
  • Event description
  • Event resource name
 
We use this information to
  • Populate your Google Calendar & Google Contacts data in your installed Application.
  • Populate your Application customer data in your Google Calendar & Google Contacts account
  • Create bookings from the Application‘s calendar for the imported/synchronized contacts
  • Keep your Google Calendar & Google Contacts in sync with your Application customers and vice versa
  • Send booking confirmation emails, booking cancellation emails, booking update emails or booking reminder emails to the contacts imported from Google Calendar & Google Contacts – prior to sending out such emails your consent will be sought each time.
 
We will only use this information for the specific reason for which it was provided to us.
 

Mobile App Analytics Usage

The Company may collect aggregate data that no longer identifies individual users for purposes of usage and performance analysis. This may include diagnostic data such as login counts, screen view counts or crash information.
 

Troubleshooting Logs Usage

For the sole purpose of troubleshooting, the Company might ask users to provide debug logs from the Application. The debug logs contain full network traffic information for application provisioning, calls, messaging and other network in-app events generated by user activity.
 

Retention of Information

We maintain your personal information in our regular business records while you are a customer of your Service. We may also maintain this information for a period of time after you are no longer a customer if the information is necessary for the purposes for which it was collected or to satisfy our legal requirements and/or obligations. These purposes typically include business, legal, or tax purposes. If there are no pending requests, orders, or court orders for access to this personal information, we may destroy the information once it becomes unnecessary to those purposes for which it was collected.
Security
The security of personal information is important to us. We take commercially reasonable measures and follow generally accepted standards to protect the information you provide us, both during transmission and once we receive it. For example, the information you provide is transmitted via encryption using technologies such as secure socket layer technology (SSL).
Disclosure to Third Parties
We do not share or sell your personal information to third parties.
We disclose information only in the following cases: as required by law, such as to comply with a subpoena or similar legal process when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, to investigate fraud, or to respond to a government request if we are involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice through our app of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information to any other third party with your prior consent to do so.

We may update this privacy statement to reflect changes to our business or this app as it pertains to the information collected from you and our use of it. If the change impacts how we use or handle information collected from you, we will email you and/or your company’s Google administrator, or post a notice where you first access this app prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.

IPitomy Privacy Policy

This Privacy Policy identifies and describes the way IPitomy Communications, LLC (IPitomy™) uses and protects the information we collect about Customers and Users. All uses of IPitomy’s products and services, as well as visits to our websites,

are subject to this Privacy Policy. This Policy applies to all Customers and Users. The Customer who holds the account with IPitomy is responsible for making sure all family members or other Users under the same account understand and agree to this Policy. Information that you provide to non-IPitomy companies is not covered by this Policy and IPitomy shall have no responsibility for protecting any such information divulged by Customer/User to a non-IPitomy company.

 

As used in this Policy, the terms listed below have the following meanings:

 

Customer -A "Customer" is anyone who purchases IPitomy products or services. When a Customer purchases retail products or services for use by others, those individuals also may be considered Customers for purposes of this Policy.

 

User A "User" is anyone who visits our websites.

 

Personal Information -"Personal Information" is information that directly identifies or reasonably can be used to identify an individual Customer or User. Examples include name, address, telephone number, email address, Social Security number, and financial account number. Personal Information does not include Published Listing Information as discussed in more detail below or information that is readily available to the public through no fault of IPitomy.

 

Anonymous Information "Anonymous Information" means information that does not directly identify and cannot reasonably be used to identify an individual Customer or User.

 

Aggregate Information "Aggregate Information" means information about groups or categories of Customers or Users, which does not identify and cannot reasonably be used to identify an individual Customer or User. Aggregate Information is a kind of Anonymous Information.

 

Website "Website" means any page or location on the Internet, no matter what device (cell phone, lap top, PC, etc.) or protocol (http, WAP, ftp or other) is used to access the page or location. In this Policy, we use the term website other similar terms such as "Internet site," "site," and "web page."

 

1. Information -We may collect different types of personal and other information based on your use of our products and services and our business relationship with you, including contact information; billing information, equipment, performance, IPitomy’s website usage, viewing and other technical information about your use of our network, services, products or websites. Information may be collected when you give it to us with the intent to purchase or interact with us about a product or service we offer or provide; when we collect it automatically when you visit our websites or use our products and services; or when we obtain it from other sources, such as credit agencies. Our goal of collecting your information is to provide you with the best customer experience possible by communicating with you regarding service updates, offers and promotions; delivering advertising that may be of interest to you; addressing network and security issues; investigating or taking action regarding illegal activities or violations of our Terms of Service or Acceptable Use Policies.We collect some information on an anonymous basis and may anonymize the personal information we collect about you into data groups. When we employ non-IPitomy companies to anonymize or aggregate data on our behalf, the requirements for sharing Personal Information with non-companies apply. We may share aggregate or anonymous information in various formats with trusted non-IPitomy entities, with whom we have contracted with to aggregate such data and may work with those entities to do research and provide products and services. When IPitomy jointly provides a service with a non-IPitomy company, your Personal Information may be subject to both this Policy and the privacy policy of the non-IPitomy company. We encourage you to review the privacy policies of any non-IPitomy company with which you do business to determine what information will be collected and how it will be used or disclosed to others.

 

2.   Disclosure -We do not sell your Personal Information to anyone for any purpose, and we maintain information about you in our business records while you are a customer, or until it is no longer needed for business, tax, or legal purposes. We have implemented encryption or other appropriate security controls to protect Personal Information when stored or transmitted by IPitomy.

 

Subject to applicable legal restrictions, such as those that exist for Customer Proprietary Network Information (CPNI), the IPitomy family of companies may share your Personal Information with each other to make sure your experience is as seamless as possible, and you have the full benefit of what IPitomy and its subsidiaries have to offer. Customer Proprietary Network Information (CPNI) is information that relates to the quantity, configuration, type, destination, location and amount of use of the telecommunications services you purchase from us, as well as the information contained in your bills for those services. We collect CPNI in the normal course of providing you with telecommunications services. Your telephone number, name and address are not CPNI.

 

We share your Personal Information only with non-IPitomy companies that perform services on our behalf, and only as necessary for them to perform those services. We require those non-IPitomy companies to protect any Personal Information they may receive in a manner consistent with this policy, and we do not provide Personal Information to non-IPitomy companies for the marketing of their own products and services without your consent. We may provide Personal Information to non-IPitomy companies or other third parties for purposes such as emergencies, pursuant to court orders, identity verification to prevent fraud and identity theft, enforcing of property rights, or obtaining payment for products and services that appear on your IPitomy billing statements.

3.  Privacy Controls -You can review and correct your Personal Information collected by us. You can limit certain types of solicitation communications from IPitomy,including marketing contacts made via telephone, e-mail and text messaging by notifying IPitomy. We will provide you with notice of changes to this policy. We are happy to correct information found to be inaccurate. Customers may verify that appropriate corrections have been made.

4.  Exclusions -Information that you provide to non-IPitomy companies is not covered by this Policy. For example: When you download applications or make an online purchase from a non-IPitomy company while using IPitomy’s services, the information collected by the non-IPitomy company is not subject to this Policy. If you use public forums — such as social networking services, Internet bulletin boards, chat rooms, or blogs on IPitomy or non-IPitomy websites —you should be aware that any Personal Information you disclose publicly can be read, collected, or used by others. Once you choose to reveal Personal Information on such a site, the information is publicly available, and IPitomy cannot prevent distribution and use of that information by other parties. IPitomy may enter into written product or service agreements with business customers that contain specific provisions related to the confidentiality, security or other handling of information. When provisions of a written product or service agreement differ from or conflict with the provisions of this Policy, the terms of the written agreement will apply. In all other instances, the terms of this Policy apply.

5. Security -We have established electronic and administrative safeguards designed to secure the information we collect, to prevent unauthorized access to or disclosure of that information and to ensure it is used appropriately. Although we strive to keep your Personal Information secure, no security measures are absolute, and we cannot guarantee that your Personal Information will never be disclosed in a manner inconsistent with this Policy (for example, as the result of unauthorized acts by third parties that violate the law or this Policy). We will make reasonable attempts to notify you if we determine that IPitomy has experienced a security breach and there is a reasonably likely risk of identity theft, or where otherwise required by law.
 

6. Policies -We have established policies and practices to meet the expectations of Customers and potential customers who have expressed a desire to limit certain types of solicitation communications from IPitomy, including marketing contacts made via telephone, e-mail and text messaging. You also can request to be removed from these telemarketing lists when you receive a marketing or promotional call. Where required by state laws and/or regulations, we honor requests from businesses to be removed from our telemarketing lists.The FTC maintains a National Do Not Call Registry at https://www.donotcall.gov/, and your state may maintain its own Do Not Call Registry. Putting your number on these Registries also may limit our telemarketing calls to that number. Our practices as described above are designed to satisfy state and federal legal requirements limiting marketing contacts. You should know that those laws and regulations —such as the requirements governing the state and federal "Do Not Call" lists —generally permit companies to contact their own current and, in some cases, former customers, even when those customers are listed on the federal and state "Do Not Call" lists. Similarly, restricting our use of your CPNI will not eliminate all types of IPitomy marketing contacts.

 

7. Online Advertising -IPitomy works hard to detect and prevent junk e-mails (also referred to as "spam" e-mails) from ever reaching your computer. 8.    Account Set-Up -When selecting User names and passwords for IPitomy accounts, you should choose words or characters that are not obvious. Likewise, you should always keep Personal Information such as account numbers, Usernames, passwords or similar information in a secure place and not share the information with others.
 

9.  Data Retention and Deletion Policy -  We retain your personal information for as logn as necessary to provide the services you have requested, or for other essential purposes such as complying with our legal obligations, resolving disputes, and enforcing our policies.  Upon your request, we will delete or anonymize your personal data unless certain legal obligations or administrative needs require retaining it.

   

10. Policy Changes -Information about our Customers and Users, including Personal Information, may be transferred as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of an insolvency, bankruptcy, or receivership in which Customer and User records would be transferred to another entity as a result of such a proceeding.

 

We reserve the right to update this Privacy Policy as necessary to reflect any changes we make and to satisfy legal requirements. If we make a material change to this Policy, we will post a prominent notice of the change on our websites, and provide you with other appropriate notice and choice regarding the use of your information, at least 30 days before the effective date.

This Acceptable Use Policy (“AUP”)

This Acceptable Use Policy (“AUP”) identifies restrictions on the use by Service Provider and its End-Users of the Services provided by IPitomy, and the software used by IPitomy to delivery such Services, and is incorporated by reference in the Master Services Agreement between IPitomy and Service Provider. Your access to the Services, and that of your End-Users, may be suspended or terminated for violation of this AUP. Capitalized terms used in this AUP shall have the meaning given in your Master Services Agreement.

Abuse

You and your End-Users may not use IPitomy’s network or Services to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including but not limited to:

  • Any purpose prohibited by applicable federal, state or local law, rule or regulation;
  • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network;
  • Using the services in excess of the average IPitomy user with similar service subscriptions.  IPitomy will use our discretion in cancelling subscriptions or recommending additional subscriptions to be purchased.
  • Using the Services without prior approval for auto-dialing, continuous or extensive call forwarding, telemarketing (including without limitation charitable or political solicitation or polling), fax or voicemail broadcasting or fax or voicemail blasting;
  • Use of the Services in any way that is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, or any similar behavior;
  • Monitoring data or traffic on any network or system without the express authorization of the owner of the system or network;
  • Interference with service to any user of the IPitomy or other network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
  • Use of an Internet account or computer without the owner’s authorization;
  • Collecting or using email addresses, screen names or other identifiers without the consent of the person identified (including, without limitation, phishing, Internet scamming, password robbery, spidering, and harvesting);
  • Collecting or using information without the consent of the owner of the information;
  • Use of any false, misleading, or deceptive TCP-IP packet header information in an email or a newsgroup posting;
  • Use of the service to distribute software that covertly gathers information about a user or covertly transmits information about the user;
  • Use of the service for distribution of advertisement delivery software unless: (i) the user affirmatively consents to the download and installation of such software based on a clear and conspicuous notice of the nature of the software, and (ii) the software is easily removable by use of standard tools for such purpose included on major operating systems; (such as Microsoft’s “ad/remove” tool); or
  • Any conduct that is likely to result in retaliation against the IPitomy network or website, or IPitomy’s employees, officers or other agents, including engaging in behavior that results in any server being the target of a denial of service attack (DoS).

Unsolicited Communications

You and/or your End-Users may not use your service to send email or any other communications to a person who has indicated that they do not wish to receive it. If the communication is bulk mail, then you will not be in violation of this section if you comply with the 48 hour removal requirement described above.

Newsgroup, Chat Forums, Other Networks

You and/or your End-Users must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.

You and/or your End-Users must comply with the rules of any other network you or your End-Users access or participate in using IPitomy’s Services.

Offensive Content

You and/or your End-Users may not publish, transmit or store on or via IPitomy’s network and equipment any content or links to any content that IPitomy reasonably believes:

  • Constitutes, depicts, fosters, promotes or relates in any manner to child pornography, bestiality, or non-consensual sex acts;
  • is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
  • is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
  • is defamatory or violates a person’s privacy;
  • creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;
  • improperly exposes trade secrets or other confidential or proprietary information of another person;
  • is intended to assist others in defeating technical copyright protections;
  • infringes on another person’s copyright, trade or service mark, patent, or other property right;
  • promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
  • is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to IPitomy; or
  • is otherwise malicious, fraudulent, or may result in retaliation against IPitomy by offended viewers or recipients, or is intended to harass or threaten.

Content “published or transmitted” via IPitomy’s network or equipment includes Web content, email, bulletin board postings, chat, tweets, and any other type of posting or transmission that relies on the Internet.

Live Events

You and/or your End-Users may not use IPitomy’s Services to stream live sex acts of any kind, even if the content would otherwise comply with the AUP. IPitomy may prohibit the streaming of other live events where there is a special risk, in IPitomy’s reasonable discretion, that the event may violate the Offensive Content section above.

Copyrighted Material

You may not use IPitomy’s network or services to download, publish, distribute, or otherwise copy or use in any manner any text, music, software, art, image, or other work protected by copyright law unless:

  • you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner; or
  • you are otherwise permitted by established copyright law to copy the work in that manner.

It is IPitomy’s policy to terminate in appropriate circumstances the services of customers who are repeat infringers.

Shared Systems

You and/or your End-Users may not use any shared system provided by IPitomy in a way that unnecessarily interferes with the normal operation of the shared system, or that consumes a disproportionate share of the resources of the system. For example, we may prohibit the automated or scripted use of IPitomy voice services if it has a negative impact on the voice system, or we may require you to repair coding abnormalities in your code if it unnecessarily conflicts with other customers’ use of the services. You agree that we may quarantine or delete any data stored on a shared system if the data is infected with a virus, or is otherwise corrupted, and has the potential to infect or corrupt the system or other customers’ data that is stored on the same system.

Use of Services Outside the United States

Although we encourage you and your End-Users to use of the Service to place calls to foreign countries from within the United States, we do not presently offer or support the Service in any countries other than the United States and Canada. If you or your End-Users use the Service outside of the United States or Canada, you and/or such End-Users will be solely responsible for any violations of local laws and regulations resulting from such use.

Other

You may only use IP addresses assigned to you by IPitomy in connection with your IPitomy Services.

You agree that if the IPitomy IP numbers assigned to your account or those of your End-Users are listed on an abuse database like Spamhaus, you will be in violation of this AUP, and IPitomy may take reasonable action to protect its IP numbers, including suspension and/or termination of your Service or that of your End-Users, regardless of whether the IP numbers were listed as a result of your actions or those of your End-Users.

SLA

No credit will be available under a IPitomy service level guaranty or agreement, if applicable, for interruptions of service resulting from AUP violations.
